Would there be any difference whether to use the definite article or not with capital punishment?

The article is not required. In fact it would be unnatural with it.

" They are on their- Time and Newsweek are on their own political agenda to encourage folks not to support the capital punishment in this country, despite overwhelming support for that."

OR

"Basically, my feeling is that the capital punishment, the death penalty is society's strongest sanction and should not be spread around, as George Bush has suggested, for every crime imaginable' cause it loses its impact, it loses its sanction."

OR

" The laws that govern them, laws of marriage and fidelity and the capital punishment for breaching them, seem carved in invisible gigantic rock."

So?

So my feeling is you could have provided those quotes from the first post (crediting the sources) and ask us if they were natural or not.

That would have been too straightforward.

Indeed! And less interesting in terms of.... whatever .
