I'm not certain about the grammar. However, I'm also not sure what you're trying to say. Perhaps: "It looks like he is listening in to our conversation."
 
What are you trying to say? The use of the subjunctive "were" is for contrary-to-fact statements. "If I were king..."

The sentence is OK if you are sure he was not listening, but he looks like he was.

If you think he really was listening, then say "he was listening." Or probably "he is listening" to match the tense in the rest of the sentence.
