I believe we are erring if we allow him to go unpunished.

Is this sentence alright?

It is probably, if you dig deep enough, technically alright.

This being said, it would be far more natural to say

"I believe that, if we allow him to go unpunished, we are making an error (or err, I suppose) in judgment."
