Are they the owner of the restaurant or something? Because it seems like the can/could do what ever they want.

Are both acceptable?
 
In this case, because of the context, I would go with "can". But the word before "can" should be "they".
 
Yes, it is.
 
"Could" would be better with "it seemed that they could..."
 
In this context, I disagree.
